Property Manager Question


Hi,

Our Association's Property Manager is married to the Association's Maintenance Person. Is this a conflict of interest?

Secondly, during a snow storm last year, a car was reportedly blocking what would be the pathway of the snow plow. The Maintenance Person moved the car and in the process, hit another vehicle causing $1000 worth of damage to the car the Maintenance person was driving (but no damage to the other car). We have a towing service to remove unauthorized vehicles. The Property Manager cut a check to the car's owner for the $1000 without informing the board. My questions: Should the Property Manager have cut this check? If the Maintenance Person's received authorization to move the car from the Property Manager, was he acting for the Association and should we be liable? Can the Property Manager give the Maintenance Person authorization to move a car since that is not his within his normal responsibilities and since we have a service to remove unauthorized vehicles?
